BillCut offers Debt Settlement, Debt Management, Debt Resolution and Assistance Services to Customers ("You/Your(s)") seeking support in resolving their outstanding Debt obligations. Depending on the Lender, Creditor, Bank, NBFC, Regulated Entity ("RE's") or any other Financial Institutions, the services may be provided through either of the following models:
BillCut may directly assist You by facilitating communications and discussions regarding available Debt Settlement and Debt Resolution Options.
The Debt Resolution Assistance, Communication and facilitations may be carried out by independent Third-Party Service Partners. In such cases, BillCut's role shall be limited to facilitating access to such Third-Party Service Partners and nothing beyond.
BillCut may directly refer you to the Regulated Entities/Lending Banks which shall either communicate and facilitate with you directly or appoint its own Third-Party service agents for the concerned task.
NOTE: YOU ACKNOWLEDGE AND AGREE THAT ANY DEBT SETTLEMENT OR DEBT RESOLUTION IS SOLELY AT THE DISCRETION OF THE CONCERNED LENDER, CREDITOR, BANK, NBFC OR RE'S. NEITHER BILLCUT NOR ANY THIRD-PARTY SERVICE PARTNERS ENCOURAGE, PROMISE, OR GUARANTEE ANY SETTLEMENT OR SPECIFIC OUTCOME. ONLY THE CONCERNED LENDER, CREDITOR, BANK OR RE'S IS AUTHORIZED TO APPROVE AND ISSUE SETTLEMENT-RELATED DOCUMENTS.
This Debt Settlement Terms of Use and Privacy Policy ("Policy" or "Agreement") governs the collection, use, disclosure, retention, and processing of personal data, as well as the rights, obligations, and responsibilities relating to your use of Billplan Fintech Private Limited's ("BillCut," "Company," "we," "us," "our"), operating under the brand "BillCut," Debt Settlement Services, including all digital interfaces, applications, portals, platforms, and communication channels used to deliver these services ("Debt Settlement Services"). This Agreement applies only to users ("you" or "Customer") who voluntarily opt-in to receive Debt Settlement Services from BillCut, whether rendered directly by BillCut or through authorised Third-Party Service Partners ("Service Partners").
PLEASE NOTE: BillCut offers credit facility services as well for which separate terms and Conditions and Privacy Policy have been defined on the platform/website. By (i) accessing the Debt Settlement and Management Services, (ii) submitting information on the BillCut platform, or (iii) providing express consent for Debt Settlement Assistance, you acknowledge that you have read, understood, and agree to be bound by these integrated Terms of Use and Privacy Policy.
These Terms govern your voluntary use of BillCut's Debt Settlement Services. By opting in to avail the Debt Settlement Services as and when explicitly intimated to you while onboarding, you agree to comply with all clauses herein and all onboarding documents provided during enrolment.
By enrolling, you expressly authorize BillCut, its employees, and its authorized Third-Party Service Partners, to act as your limited purpose representative solely for the purpose of communicating and facilitating Debt Settlement proposals with your identified Lender, Creditor, Bank, or RE's (Hereinafter referred to as "REs").
BillCut may partner with other Third-Parties Service Partners to provide specific portions of the Services, if required. When You sign-up for the Services, BillCut may share certain requisite Personal Information and Sensitive data to the extent necessary for the Third-Party Service Partners to provide these Services. Our contractual arrangements with such Third-Party Service Partners restrict these parties from using personally identifiable information except for the explicit purpose of assisting in the provision of these Services.
You acknowledge and agree that the Debt Settlement process is a multi-step engagement involving Data Collection, Facilitation, and Final Settlement, with the following typical stages (which may vary based on the specific Creditor and/or Third Party Service Partner):
BillCut collects your identification data (Name, Mobile Number, PAN) and secures your explicit consent to pull your Credit Report from Third-Party Credit Bureau's Partners that is necessary to render the Services availed under the Debt Settlement Mechanism and also obtain full details of outstanding debts. You may voluntarily share supplemental information (e.g., personal/work email, address, education, etc.) to aid in financial assessment as and when required during the process.
You acknowledge the nature of the Debt Settlement Services (as displayed on the platform) and provide clear consent to enrol, which explicitly includes consent for the necessary usage and sharing of your data with authorized Third Party Service Partners and Creditors/Lenders/REs solely for debt resolution purposes.
BillCut shares the necessary Customer details (Name, PAN, Mobile, CRIF Details) with the assigned Third-Party Service Partners. The Third-Party Service Partner, engages in facilitation with the Creditor/ Lenders/Bank/REs to secure a potential waiver or Settlement proposal/offer.
The Settlement amount is communicated to you by BillCut or its Third-Party Service Partners through already established mode of communication explicitly consented to by the Customer which can be vide email, Phone calls SMS, in-app notifications. Then only upon your explicit, voluntary confirmation of willingness to accept the proposed Settlement offer and waiver amount, your case proceeds.
Upon your acceptance, the Lender/Creditor/Bank/NBFC/RE's issues the formal Settlement confirmation and the required payment link. Payment terms (initial and final tranches) are handled as per the specific creditor's mandate. Additionally, in the event that there is a Third-Party Service Partner involved then such Third-Party Service Partner shall also undertake sufficient steps to put forward the reminders of the above two.
DOCUMENTATION DISCLAIMER: YOU EXPRESSLY ACKNOWLEDGE AND COVENANT THAT THE FINAL ISSUANCE OF ALL OFFICIAL AND CONCLUSIVE SETTLEMENT DOCUMENTS OR THE WAIVER CERTIFICATE/LETTER OR THE NO-OBJECTION CERTIFICATE (NOC) IS THE EXCLUSIVE PREROGATIVE OF THE RESPECTIVE BANK, NBFC, REGULATED ENTITY (RE), OR CREDITOR, TO THE COMPLETE EXCLUSION OF BILLCUT OR THE THIRD-PARTY SERVICE PARTNERS.
BillCut and it's Third-Party Service Partners shall not be responsible, nor held liable, for the content, delivery, or timeline of any Settlement Letter, Final No Objection Certificate (NOC), Waiver Certificate/Letter or any other documents confirming the resolution of the debt issued post-acceptance of the Settlement and payment of the agreed Settlement amount. You understand and agree that BillCut have no authority to issue any of the above documents.
BillCut's capacity is strictly limited to an intermediary and facilitator of communication post Your express consent.
BillCut acts as a Debt Resolution Advisor, providing Financial Analysis, Repayment Restructuring Suggestions, Facilitation, Coordination and wherever require primarily connecting you to appropriate Third-Party Service Partners.
BillCut makes NO GUARANTEE, PROMISE, ASSURANCE, REPRESENTATION, OR WARRANTY, EXPRESSED OR IMPLIED, regarding the successful Settlement of any debt, the percentage waiver achieved, or the long-term impact on your financial standing or future borrowing ability.
You understand and agree that BillCut does NOT provide legal advice or legal representation. You must deal with any litigation filed in court by the bank/REs/Creditor/NBFC, and BillCut is or shall NOT be responsible for providing legal counsel in such matters. You also understand that BillCut is not a licensed broker either and shall only render its role as that of a facilitator to initiate a Settlement or resolution or settlement of your loans/debt.
The final, binding Settlement document (including but not limited to the issuance of a "No Dues Certificate", Settlement Letter, Final No Objection Certificate (NOC), Waiver Certificate/Letter or any other documents upon fulfilment of the Settlement terms) is executed directly between You and the respective Bank/Creditor/NBFC/RE's and BillCut shall have no role, responsibility, or involvement in the issuance, execution, or delivery of any such document.
You acknowledge, consent, and agree that BillCut may, in certain cases, operate through Third-Party Service Partners Assisted Services model, whereby BillCut may introduce, refer, connect, or redirect You to independent Third-Party Service Partners, Consultants, Advisors, Legal Professionals, or Other Service Partners for the purpose of facilitating Debt Settlement, Debt Resolution, Or Related Services via intimation through BillCut Platform or your registered Email ID or other registered communication mediums.
You acknowledge and agree that BillCut's role in relation to any Third-Party Service Partner shall be strictly limited to facilitating an Introduction, Referral, or Connection between You and such Third-Party Service Partner. BillCut SHALL NOT be responsible for the provision, quality, performance or favorable outcome of any services rendered by the Third-Party Service Partner.
Where You are referred to a Third-Party Service Partner, You may be required to access, register, interact, or avail services through the platform, website, application, or infrastructure of such Third-Party Service Partner in order to proceed with or complete the Debt Management, Debt Settlement, Debt Resolution, or Related Services.
You acknowledge and agree that the services provided by a Third-Party Service Partner shall be governed by separate Terms and Conditions, Privacy Policies, Service Agreements, Mandates, Consents, Engagement Letters, Or Other Contractual Arrangements that may be required to be accepted or executed directly between You and the concerned Third-Party Service Partner. Such arrangements shall create a separate and independent contractual relationship exclusively between You and the Third-Party Service Partner, and BillCut SHALL NOT be a party thereto. The Third Party Service Partner may charge an additional or separate Fee from You as envisaged under Clause 5.9 of this Agreement.
BillCut shall not be responsible or liable for any Fees, Charges, Obligations, Representations, Warranties, Acts, Omissions, Deficiencies, Delays, Disputes, Losses, Damages, Claims, or Liabilities arising from or relating to the services provided by any Third-Party Service Partner. All rights, obligations, and remedies relating to such services shall be governed exclusively by the arrangements entered into between You and the concerned Third-Party Service Partner to the complete exclusion of BillCut.
The scope of Services, Fees, Deliverables, Timelines, Obligations, Service Standards, Representations, Warranties, Liabilities, and all Other Commercial or Contractual Terms relating to the services of a Third-Party Service Partner shall be determined solely between You and the concerned Third-Party Service Partner to the complete exclusion of BillCut.
You acknowledge and agree that neither BillCut nor any Third-Party Service Partner guarantees any Debt Settlement, Waiver, Debt Reduction, Creditor Approval, Settlement /Waiver Certificates, Favorable Outcome/Results. Any Debt Settlement, Resolution, Waiver, Compromise, Or Settlement Proposal shall remain exclusive prerogative and sole discretion of the concerned Lender, Creditor, Bank, NBFC, RE's.
You understand, acknowledge, and expressly agree that engaging in a Debt Settlement Or Debt Resolution Process, as mediated or facilitated by Billcut or through their Third-Party Service Partners, will result in the loan being reported by the Lender, Creditor, Bank, NBFC, RE's to the Credit Information Companies (CICs) as "Settled" or "Written-Off," which may or may not be considered a NEGATIVE MARK on Your credit profile.
YOU ACKNOWLEDGE THAT THIS ACTION WILL SEVERELY AND ADVERSELY IMPACT YOUR CREDIT SCORE (CIBIL/Experian/etc.) AND CREDIT RATING, AND THIS NEGATIVE STATUS MAY REMAIN ON YOUR CREDIT REPORT FOR A CONSIDERABLE AMOUNT OF TIME.
You acknowledge and agree that neither Billcut nor the Third-Party Service Partners is responsible for the reporting actions of Lender, Creditor, Bank, NBFC, RE's or the resultant decline in Your credit score.
You covenant and agree to:
Provide accurate and truthful financial and personal information and documents promptly.
Maintain timely communication with BillCut and its Third-Party Service Partners regarding any creditor contact or Settlement updates.
Make all agreed payments toward Settlements directly to the creditor or through the authorized payment channel as instructed by the creditor.
Not engage multiple Debt Settlement agencies or advisors simultaneously for the same debt accounts during the Service Period. ("Service Period" shall mean the period commencing from the date of payment of the applicable Platform Fee and continuing until whichever is later out of: (i) Expiry of the validity period specified under Clause 5.3; (ii) completion of assistance undertaken by BillCut or its Third-Party Service Partners in relation to the relevant Debt; (iii) Expiry or Withdrawal or Forfeiture or Rejection of any settlement offer made available by the concerned Lender, Creditor, Bank or RE's through BillCut or its Third-Party Service Partners.)
Acknowledge that while pursuing Debt Resolution and Settlement, you may be required to cease payments to creditors, and this decision may carry risks, including negative credit score impact, late fees, and potential legal action from the creditor.
Depending on the service plan selected by You, BillCut and/or it's Third-Party Service Partners shall charge a platform fees, and/or such other charges as may be handled at the time of onboarding or availing the Debt Settlement Services.
To access and avail the Debt Resolution Services and Settlement opportunities facilitated through the BillCut platform, You shall be required to pay a Platform Fee, the amount of which shall be communicated to You prior to payment. BillCut reserves the right to revise the Platform Fee from time to time without any prior intimation, and any such revised fee shall apply prospectively. Should you choose not to avail such revised charges, You shall have the option of withdrawing from availing such service.
Upon successful payment of the Platform Fee, Your access to the Debt Resolution Services and Settlement opportunities made available through the BillCut platform shall remain valid for a period of thirty (30) days from the date of such payment ("Validity Period").
Any Settlement offer, proposal, or opportunity received from the relevant Lenders, Bank, Creditor, NBFC, RE's may be communicated, displayed, or made available to you by BillCut or Third-Party Service Partners of BillCut through already established mode of communication explicitly consented to by the customer which can be vide email, Phone calls, Chat/Voice Bots, SMS, in-app notifications. BillCut or any Third-Party Service Partner does not guarantee the availability, continuation, renewal, or reissuance of any Settlement offer, post expiry of validity period.
Any Settlement offer communicated to You may be Reviewed, Considered, Accepted, Or Rejected at Your sole discretion. The validity of a Settlement offer shall depend upon the terms specified by the Concerned Lender, Creditor, Bank, NBFC or RE's and shall be communicated to You at the time the offer is made available. Where a Settlement offer is facilitated through a Third-Party Service Partner, the Validity, Terms, Conditions, and Availability of such offer shall be governed by the arrangements and agreements entered into between You and the concerned Third-Party Service Partner and shall be communicated to You by such Third-Party Service Partner. Where BillCut directly assists in facilitating a Settlement offer, the validity period of such offer may vary from creditor to creditor and shall be communicated to You at the time the offer is made available. BillCut does not guarantee the Availability, Extension, Renewal, Or Continuation of any Settlement offer beyond the validity period specified by the concerned Lender, Creditor, Bank, NBFC, RE's.
If any Settlement offer is not accepted or availed by You within the applicable validity period, such offer shall expire, lapse or cease to be available without any liability on the part of BillCut. Upon expiry of the validity period, Your access to the Debt Settlement Services associated with the relevant Platform Fee payment shall automatically terminate.
You acknowledge and understand that Debt Settlement is a lengthy process and the successful resolution of the debt may take more than the validity period of the Platform Fee. In the event You fail to actively participate in the Services, for a period of Thirty (30) Days, from the date a Settlement offer has been made available then the validity of the Platform Fee shall expire on such 30th Day. In the event you are introduced to a Third-Party Service Partner via intimation on BillCut's Platform or your registered Email ID or other registered communication mediums, Your failure to Onboard, Register, or Engage with the concerned Third-Party Service Partner within thirty (30) days from the date of such intimation shall be deemed inactivity and shall result in automatic expiry of the Platform Fee validity without any refund. Should you choose to avail the service again you give your consent to re-pay a platform fee, whereupon a new validity period shall commence subject to availability and the policies of the concerned Lenders, Bank, Creditor, RE's.
You understand and agree that THE PLATFORM FEE IS NON-REFUNDABLE in any circumstance whatsoever.
You acknowledge and agree that certain Services, Products, Documentation, Verification Processes, Payment Facilitation Services, Advisory Services, or Other Ancillary Services may be provided by independent Third-Party Service Partners towards the Lenders, Banks, Creditors, REs. Such Third-Party Service Partners may levy separate fees, charges, costs, commissions, or expenses directly upon You. Any such fees or charges shall be solely between You and the relevant Third-Party Service Partners shall be entirely independent of and in addition to any fees payable to BillCut. BillCut shall neither be responsible nor liable for determining, collecting, refunding, waiving, or disputing any such Third-Party Service Partners fees or charges.
You agree that BillCut, its affiliates, officers, shareholders, directors, employees, or representative, agents, partners, co-branders, licensors, licensees, consultants, or contractors shall not be liable to You or any third party for any direct, indirect, incidental, special, consequential, or punitive damages or losses whatsoever, including loss of profit or opportunity, or damages for loss of data or profits, goodwill, and/ or other intangible loss, whether or not foreseeable and regardless of whether BillCut has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of, or access to, the BillCut Platforms, BillCut Application or BillCut Services or any legal action initiated by Your Lenders, creditors, Banks, RE's arising out of or in connection with Your use of this service, Your decision to default, or the final outcome of any debt settlement.
In no event shall BillCut's total cumulative liability to You in connection with the BillCut Services for all damages, losses and causes of action (whether arising under contract or otherwise), arising from or relating to Your use of the BillCut Platform and website or arising from these Terms of Use exceed INR 10,000 (Indian Rupees ten thousand only).

BillCut may terminate services immediately, without liability, if fraudulent activity is detected, repeated non-cooperation occurs, payments towards the Settlement are defaulted, or if there is a material breach of these terms.
Customers may terminate the Services anytime by providing written notice to BillCut and choose to opt out of the availed Services by writing to BillCut at help@billcut.com. Any fees already paid remain non-refundable.
These integrated terms shall be governed by and construed in accordance with the laws of India. Subject to the Grievance Redressal mechanism, the courts in New Delhi shall have exclusive jurisdiction over all matters arising out of or relating to this Agreement subject to Clause 10 hereinbelow.
In accordance with all applicable laws and guidelines, the designated Grievance Officer shall address any discrepancies, disputes, or grievances you may have regarding the Services or the processing of your data expeditiously.

Hence, we call upon you to keep a regular check on the same at regular intervals so as to freely keep availing the Services opted for. In the event you continue to avail the Services even after such changes or amendments to these integrated Terms and privacy Policy, BillCut will constitute that the same is your consent to the changed terms.

You represent and warrant that You have read and agreed to be bound by all applicable Terms of Use and policies for any Third-Party Service Partners websites. That links to such sites are provided as Services to users and are not sponsored by or affiliated with BillCut. That the Links to such Third-Party Service Partners services, obligations, terms and conditions as laid down by such Third-Party Service Partners Service providers are provided on BillCut for the ready perusal of the Customer. That such links are to be accessed at the Customer's own risk, and BillCut makes no representations or warranties about the content, completeness or accuracy of the sites linked to or from this site. You undertakes agrees to hold BillCut harmless from any and all liability related to Your use of a Third-Party Service Partners website.
BillCut shall not be liable for any failure or delay in performance of its obligations under this Terms of Use arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, acts of God; earthquakes; fires; floods; wars; civil or military disturbances; acts of terrorism; sabotage; strikes; epidemics; pandemics; riots. So as to claim the benefit of this provision, BillCut shall as soon as reasonably practicable after the occurrence of any such event: (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance as specified under this Agreement as soon as practicable.
If any provision of this Terms of Use or the application thereof is held to be invalid, void or unenforceable for any reason, the remaining provisions not so declared will be construed so as to comply with the law, and will nevertheless continue in full force and effect without being impaired in any manner whatsoever.
Neither party to this Terms of Use shall seek to have any term, provision, covenant, or restriction of this Terms of Use to be held invalid. This Agreement shall inure to the benefit of and be enforceable by the successors and assigns of BillCut, any person or entity which purchases substantially all of the assets of BillCut or with whom BillCut merges, and any subsidiary, affiliate, corporation, or operating division of such entities.
BillCut reserves it's right to amend, change, add, or delete any and all clauses/terms and conditions of this Agreement at its discretion. You shall be required to keep a regular check and update yourself with any and all changes, additions, amendments, deletions and otherwise that BillCut shall come up with time and again to revise these Terms of Use. You voluntarily agree and understand that there shall be no specific intimation from BillCut on such changes and revisions. As of the effective date of the revised Terms of Use of Debt Settlement, You will be considered as having consented to all changes and revisions to these Terms of Use Debt Settlement.

This includes contacting you even if your number is listed on the National Do Not Call (DND) Registry, as this constitutes essential transactional and contractual communication.
Using AI-powered tools for debt profiling, Settlement recommendation frameworks, risk assessment, and process optimisation.
