To access and avail the services of BillCut, You may be asked to provide certain registration details or other information while signing up for a new account. You undertake, represent and warrant and state beyond any doubt that the information you provide on this site will be correct, current and complete in all aspects.
That the Customer is required to sign up with a new account on BillCut for which certain personal information shall be collected by BillCut. BillCut collects Personal Data that is voluntarily provided by the Customer such as the information when You sign up and log in to avail the Services on BillCut, contact us with inquiries, register for access to the Website or purchase services from the Website. That such information is governed and aptly safeguarded by the Privacy Policy set by BillCut available at https://www.billcut.com/data-security and the same shall be read as an integral part of this Terms of Use.
That the Customer undertakes that he/she is 18 years of age or older and is legally a Major so as to avail the Services provided by BillCut. That BillCut shall not be responsible and/or liable for any such misrepresentation by the Customer with respect to any of the Personal Data that the Customer provides. BillCut reserves its right to refuse You access to BillCut or any of its resources, and to terminate or suspend Your access and subscription at any time if the information You provide is found to be incorrect, not current or incomplete.
You may use the Services available on BillCut for purposes expressly permitted by BillCut. As a condition of Your use of the services provided by BillCut, You warrant to BillCut that You will not use the website for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

The Customer also understands that the services may include certain communications from BillCut as service announcements and administrative messages. The Customer understands and agrees that the services are provided on an "as is" basis and that BillCut does not assume any responsibility for deletions, mis-delivery or failure to store any Customer communications or personalized settings.
The Customer agrees that by applying on the BillCut.com , BillCut and/or its Lending Partner or any Third-Party Service Provider may contact the Customer with personalized offers on products & services through SMS, WhatsApp, RCS, Email, telephonic calls/bots, Chat/Voice Bots, in-app notifications or any other established end to end encrypted mode of communication. The Customer acknowledges that this consent constitutes a fresh, voluntary and valid consent and shall supersede any prior withdrawal of consent or communication preferences provided by the Customer, including any DND and/or NDNC registration. This consent shall remain valid for a period of 365 days from the date on which it is provided, unless withdrawn earlier in accordance with applicable law.
The Customer agrees that any and all damages, liability (criminal, civil or otherwise) qua the subject matter that might arise shall be the sole responsibility of the Customer. In addition to the aforementioned, the Customer undertakes to abide by the restrictions laid down in Clause 2 qua the subject matter. That the Customer agrees that the Customer shall borne all responsibility and legal liability in such an event.
BillCut is for Your personal and non-commercial use, unless otherwise specified. You may not use BillCut for any other purpose, including any commercial purpose, without the knowledge of BillCut and without the express prior written consent by BillCut. You may not modify, copy, distribute, display, send, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, content, software, products or services obtained from or otherwise connected to BillCutor any other third party service providers, unless expressly permitted by these terms.
The material and content accessible from BillCut, and any other subdomain owned, operated, licensed, or otherwise controlled by BillCut is the proprietary information of BillCut or a third party that provided this Content to BillCut whereby BillCut or such providing party retains all right, title, and interest in the Content, respectively.

BillCut reserves the right, in its sole discretion, to terminate your access to any or all of BillCut websites and the related services or any portion thereof at any time, without notice.
Upon termination of the Service, the Customer's right to use BillCut and its Services shall immediately stand cancelled and ceased. The Customer shall have no right and BillCutshall have no obligation thereafter to execute any of the Customer's uncompleted tasks.
The Customer agrees that once the Customer's registration or the Services are terminated, cancelled or suspended, any data that the Customer has stored on the Website may not be retrieved later.
The Customer shall indemnify and hold BillCut, its subsidiaries, affiliates, licensors, service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties”) harmless from any breach of these Terms of Use by You.
The Customer agrees that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and You agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses and attorneys’ fees of the Indemnified Parties in connection therewith.
The Customer agrees that it shall also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of the Customer’s use of the Services availed through BillCut.
The Customer undertakes and agrees that any misuse of the Trademark or Copyrighted works displayed in BillCut, or any other content on BillCut, is strictly prohibited and may expose the Customer to legal liability under this Agreement/terms of Use.
The Customer agrees and understands that the customer is bound by the Terms and Conditions entered into with lending partners of Billcut. The customer agrees and understands that the customer cannot remit and/or refund, in any case whatsoever such amount availed from the lending partner. The customer agrees and understands that Billcut has its own KYC registration process and policies that the customer has to adhere to at the time of making an account on Billcut. The customer will be required to confirm his/her credit card details via a third party payment gateway, for which a transaction of ₹1 shall be done from the customer's credit card. The customer understands and agrees that such transaction is irreversible and no refund shall be given for the same.
The Customer understands and agrees that any passwords used for BillCut are for individual use only. You agree and undertake that You will be responsible for the security of your password. BillCut will be entitled to monitor your password and, at its discretion, require You to change it. If You use a password that BillCut considers insecure, BillCut will be entitled to ask You to change the password.
You are prohibited from using any services or facilities provided in connection with this site to compromise security or tamper with system resources and/or accounts. If You become involved in any violation of system security, BillCut reserves the right to release Your details to system administrators at other sites in order to assist them in resolving security incidents. BillCut reserves the right to investigate suspected violations of these Terms of Use.
BillCut reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing BillCut to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms of Use.
By accepting this agreement, You waive and hold harmless BillCut from any claims resulting from any action taken by BillCut during or as a result of its investigations and/or from any actions taken as a consequence of investigations by either BillCut or law enforcement authorities.
That the Customer agrees that his/her personal data can be used for internal testing and development purposes in order to make continuing improvements to the Services availed on BillCut.
BillCut shall take all reasonable and prudent technical precautions so as to safeguard the database of the Customer (data and information provided by the Customer). The Customer agrees that BillCut shall not be liable/responsible in the unforeseeable event of complete or partial loss and breach of the database for any reason whatsoever.
The customer / user understands that BillCut would be sharing their data to it's lending partners for the purpose of getting a loan offer. In this process, the "partner" of BillCut would be making a Credit Bureau "Hard Pull" to assess the customer's profile. BillCut maintains a list of it's partners at https://billcut.com/partners
Procedure: Any and all disputes and/or grievances regarding the present Terms of Use have to be resolved following the procedure available at https://www.billcut.com/data-security
BillCutshall not be liable for any failure or delay in performance of its obligations under this Terms of Use arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, acts of God; earthquakes; fires; floods; wars; civil or military disturbances; acts of terrorism; sabotage; strikes; epidemics; pandemics; riots. So as to claim the benefit of this provision shall, BillCut as soon as reasonably practicable after the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance as specified under this Agreement as soon as practicable.
The interpretation, performance and enforcement of this Terms of Use will be governed by the laws of India without giving effect to any choice of law or rule that would cause the application of the laws of any jurisdiction other than the laws of India to the rights and duties of the parties. The laws of India and the courts at New Delhi, India shall alone have jurisdiction.
If any provision of this Terms of Use or the application thereof is held to be invalid, void or unenforceable for any reason, the remaining provisions not so declared will be construed so as to comply with the law, and will nevertheless continue in full force and effect without being impaired in any manner whatsoever.
Neither party to this Terms of Use shall seek to have any term, provision, covenant, or restriction of this Terms of Use to be held invalid. This Agreement shall inure to the benefit of and be enforceable by the successors and assigns of BillCut, any person or entity which purchases substantially all of the assets of BillCut or with whom BillCut merges, and any subsidiary, affiliate, corporation, or operating division of such entities.
BillCut reserves it's right to amend, change, add, or delete any and all clauses/terms and conditions of this Agreement at its discretion. You shall be required to keep a regular check and update yourself with any and all changes, additions, amendments, deletions and otherwise that BillCut shall come up with time and again to revise these Terms of Use. You voluntarily agree and understand that there shall be no specific intimation from BillCut on such changes and revisions. As of the effective date of the revised Terms of Use, You will be considered as having consented to all changes and revisions to these Terms of Use.

You agree to provide accurate and complete information required for identity verification and retrieval of Your Credit Information. You acknowledge that Billcut relies on the data provided by You and the respective CICs, and Billcut assumes no liability for the accuracy, completeness, or timeliness of the Credit Information received from the CICs.
