CIBIL says that in jointly held accounts you are held equally liable for missed payments, and RBI’s rules for credit information companies say a credit report shows loans taken as borrower, co-borrower or guarantor. So both people stay tied to the EMI and to each other’s payment record until the loan is changed or closed. This post covers the credit and lender side only.

It does not cover property rights, maintenance or court orders. Those depend on your case and on the law, so speak to a qualified lawyer for them.

Who is responsible for the EMI after a divorce?

Your divorce papers and your loan contract are different things. The lender signed the loan with both borrowers. On CIBIL’s credit score and loan basics FAQ, the position is clear: in co-signed or jointly held accounts, you are held equally liable for missed payments. CIBIL also says another holder’s missed payments can affect your own access to credit.

We cannot say how any court or agreement will split the EMI between two people. That is a legal matter. What we can say is that the lender’s record of the loan is a separate thing from a private understanding between the two borrowers.

How does the loan show on each credit report?

RBI’s Credit Information Companies Directions require credit information companies to capture co-borrower and guarantor details where applicable. The report shows loans a person has taken as borrower, co-borrower or guarantor. So a joint home loan can appear on both reports, each with its role.

CIBIL describes each person as having an individual report and score. A late or missed EMI on the shared loan can therefore show on both files. The CIBIL score guide says late payments or defaults on EMIs have a negative impact on the score.

What options do people discuss with the lender?

We found no RBI or CIBIL page that lists divorce options or the rules for them, so we do not state what any lender allows. These are common topics to raise, and each one needs the lender’s agreement and legal advice.

Topic

What it generally means

Ask the lender

Refinance in one name

One person takes a new loan that pays off the joint loan

Does my income and credit record qualify alone?

Buyout of one party

One person keeps the property and takes over the loan

What is the process and what papers are needed?

Sale of the property

The sale amount clears the loan

What is the closure process and the outstanding amount?

Continue as is for now

Both stay on the loan while EMIs are paid

How will missed EMIs be reported for each of us?

The bank or lender decides on its own credit policy, as CIBIL states. Approval is never assured.

What does a simple example look like?

This example is illustrative. The numbers are made up and are not a BillCut offer.

Joint home loan EMI: Rs 40,000 a month.

Person A earns Rs 90,000 a month and has other EMIs of Rs 10,000.

Person B earns Rs 50,000 a month.

If an understanding between them breaks down and one EMI is missed, the lender’s record of that account can affect both credit reports. If Person A wants to apply for a loan alone later, the lender will look at A’s income, A’s other EMIs and the report. That report may include the shared loan. Reducing other high interest dues can free room for A’s side of the load. Check your options with BillCut if that applies to you.

What should you do first?

Keep paying the EMI on time while talks continue, and keep proof of every payment.

Get your free full credit report. RBI’s directions give one per calendar year from each credit information company. Your former partner can do the same.

Check how the joint loan and other accounts appear.

Write to the lender to ask what changes are possible and what each needs.

Take legal advice for property and payment sharing before you sign anything.

If a report has errors, raise a dispute. CIBIL’s disputes FAQ says this takes about 30 days, depending on the lender.

For related reading, see our posts on common joint loan mistakes, co-applicant responsibility on default, why co-applicants matter and home loan balance transfer.

How BillCut can help

BillCut is a balance transfer and debt reduction platform. It works with lending partners to help eligible borrowers move high interest dues, such as credit card balances and personal loan EMIs, into one structured EMI. BillCut earns from helping borrowers refinance, so it has an interest in this option. Approval and terms depend on the partner lender. It does not handle legal questions about divorce or property.

Frequently asked questions

Does divorce remove my name from the joint home loan?

No. The loan stays with the lender until it is changed or closed.
