In India, “payday loan” usually means a small, short term app loan or salary advance. A settlement can end collection calls, but it is reported as “settled”, not “closed”, and lenders may treat that as a warning sign. Try cheaper routes first, and settle only in writing with a lender you have verified.

What counts as a payday loan in India?

There is no separate legal product called a payday loan in India. People use the term for small ticket loans taken through an app, often repaid from the next salary in a few weeks or months. Some are issued by banks or NBFCs. Others are offered by apps that act as agents of a regulated lender. The rules depend on who actually lends the money. These points matter when you plan a settlement:

Loans must be paid out into your own bank account, and you repay directly to the lender’s account, not to a third party.

The lender stays responsible for your complaint even when an app handles the interface.

If your complaint is rejected, or gets no reply within 30 days, you can escalate to the RBI through its complaint portal.

Recovery agent details must be sent to you by email or SMS before the agent contacts you.

You get an explicit option to exit a digital loan within a cooling off period by paying the principal and proportionate annual percentage rate, with no penalty. The period is set by the lender and cannot be less than one day.

What must the loan paperwork show?

Under the RBI circular on Key Facts Statements, lenders must give a KFS before the loan contract is signed. It includes the annual percentage rate, which covers all charges levied by the lender, and the repayment schedule. A charge not stated in the KFS cannot be levied during the loan without your explicit consent. Keep your KFS. It is the baseline for any settlement talk, because it shows what you were told you would owe.

How does a settlement affect your credit?

CIBIL explains that a loan is shown as “settled” when the borrower pays less than the full amount owed, whereas a fully paid loan shows as “closed”. In its article on the impact of settled status, CIBIL says lenders view “settled” as risky, and its example shows a loan application rejected for this reason. CIBIL suggests paying dues in full where possible and checking your report afterwards. Get a closure or no dues letter in writing when you settle.

How do you negotiate a settlement safely?

Confirm the lender is real. RBI planned a public list of digital lending apps linked to regulated entities, meant for checking an app’s claim. Our guide to checking the RBI list shows how.

Ask for the outstanding amount in writing, split into principal, interest and fees.

Compare it with your KFS and flag any charge you were never told about.

Make a written offer from your own bank account to the lender’s account only.

Get a settlement letter stating the amount and that no dues remain, before you pay.

Pay, then collect the closure letter and check your credit report after the lender updates it.

If you want to look at refinancing instead of settling, Check your options with BillCut.

Illustrative example

This example is illustrative only and is not a BillCut offer. Ravi borrowed Rs 15,000 on an app and now owes Rs 21,000 after fees and charges. The lender offers to close for Rs 17,000. Ravi first checks the KFS and finds Rs 1,200 of a fee that was never listed, and asks for it to be removed. He gets the revised figure and a no dues letter in writing before paying. Without the letter, he could be chased again for the balance.

What about harassment during recovery?

Recovery calls must stay within legal limits. See recovery rules for Indian borrowers and note down every call, with date and time. Raise a written complaint with the lender first.

How BillCut can help

BillCut is a balance transfer and debt reduction platform.
