The main differences are how the rate is set, how fast you may get approved, and what the lender itself can do. Compare offers by total cost, not by lender type.

What is an NBFC, and how is it different from a bank?

A non-banking financial company, or NBFC, is a company registered under the Companies Act whose main business is lending and investing. The Reserve Bank of India regulates it, but it is not a bank.

According to the RBI’s FAQs on NBFCs, NBFCs cannot accept demand deposits, are not part of the payment and settlement system, and cannot issue cheques drawn on themselves. Deposit insurance from DICGC is also not available to NBFC depositors. For a borrower, the loan rules below matter more.

How are interest rates set on bank vs NBFC personal loans?

This is the clearest rule difference. Since 1 October 2019, banks must link new floating rate retail loans to an external benchmark such as the repo rate, and reset the rate at least once in three months, under the RBI’s external benchmark circular. That circular is addressed to banks, not NBFCs, so an NBFC’s floating rate may follow its own internal benchmark.

If your personal loan is floating and EMI based, the RBI’s rules on reset of floating rates on personal loans apply to banks and NBFCs alike. You must be told when a reset raises your EMI, you can choose a higher EMI or longer tenure, and you can prepay at any time.

Which rules are the same for banks and NBFCs?

Key Facts Statement: retail term loans sanctioned on or after 1 October 2024 come with a KFS showing the annual percentage rate and repayment schedule, and a charge not in the KFS needs your explicit consent, under the RBI’s KFS circular.

Penal charges: a late or default penalty must be a disclosed, reasonable charge, not extra penal interest, and no interest can be charged on it, under the RBI’s penal charges circular.

Pre-payment: for floating rate loans to individuals for non-business purposes, sanctioned or renewed on or after 1 January 2026, banks and NBFCs cannot levy pre-payment charges, with no lock-in, under the RBI’s pre-payment charges directions. Fixed rate loans follow the lender’s policy, and any charge must be disclosed upfront.

Bank vs NBFC personal loan: a side by side comparison

Point

Bank

NBFC

Interest rate

Floating retail loans linked to an external benchmark

May use its own benchmark; rate may be higher or lower

Speed and eligibility

Usually stricter checks on income and credit score

May approve faster and accept a wider range of profiles, sometimes at a higher rate

Rules that are the same

KFS, penal charges, floating rate reset rights, no pre-payment charge on floating rate loans

Same as banks

Rules that differ

Accepts demand deposits, issues cheques, DICGC cover for depositors

None of these

How to complain

Lender first, then RBI Integrated Ombudsman

Lender first, then RBI Integrated Ombudsman if the NBFC is covered

On complaints, the RBI’s Integrated Ombudsman Scheme brought banks and NBFCs under one scheme. The RBI’s NBFC FAQs add that it covers NBFCs that accept deposits, or that deal with customers and have assets of Rs 100 crore or more, and that you can approach the ombudsman if the NBFC does not resolve your complaint within one month. See BillCut’s guide to an RBI ombudsman complaint.

A short aside on loans against shares: banks can lend up to 60% of the value of listed shares under the RBI’s 2026 credit facilities amendment, while the RBI’s NBFC FAQs say NBFCs must keep a 50% loan to value ratio on such loans.

Does a lower interest rate always mean a cheaper loan?

No. A processing fee can wipe out a small rate difference. It works with lending partners to help eligible borrowers move high interest dues, such as credit card balances and personal loan EMIs, into one structured EMI. BillCut earns from helping borrowers refinance, so it has an interest in this option. Approval and terms depend on the partner lender, and a switch only makes sense if the total cost after fees is lower.

Frequently asked questions

Is it safe to take a personal loan from an NBFC?

An NBFC registered with the Reserve Bank of India follows RBI rules on loan disclosure, penal charges and pre-payment, much like a bank.
