Check that first, then use the rights below. For the wider rulebook, see BillCut’s summary of RBI guidelines for loan apps.

What are your loan app borrower rights at a glance?

Your right

What the 2025 Directions say

What to watch for

Key Fact Statement

The lender must give you a KFS

Charges not in the KFS need your explicit consent

Cooling-off period

Exit by paying principal and proportionate APR, without penalty

The lender may keep a one-time processing fee disclosed in the KFS

Direct money flow

Loans go to your account and repayments to the lender’s account

No pass-through or pool accounts of third parties

Data limits

Need-based collection with your explicit consent

No access to files, media, contacts or call logs

Grievance officer

Contact details shown on the app, websites and KFS

Escalate to the RBI if there is no reply within 30 days

What must the Key Fact Statement show you?

Under the RBI’s KFS circular, the KFS must be in a language you understand. It must include an annual percentage rate (APR) computation and a repayment schedule.

Any fee not shown in the KFS cannot be charged at any stage without your explicit consent. After the loan, the signed documents must reach your registered email or SMS.

How does the cooling-off period work on a digital loan?

You get an explicit option to exit the loan during a cooling-off period by paying back the principal and the proportionate APR, with no penalty. The lender’s board sets the length of the period, which must be at least one day. The lender may keep a reasonable one-time processing fee, but only if the KFS discloses it upfront.

An illustrative example, not any lender’s actual terms:

Illustrative item

Amount

Loan amount

Rs 20,000

APR

30% a year

Days before you exit

3

Proportionate APR for 3 days

About Rs 49

One-time processing fee disclosed in the KFS

Rs 500

Total to exit

About Rs 20,549

Exiting early limits interest to a few days, but the processing fee can be the bigger cost. The period may be as short as a day, so read the KFS first. BillCut explains more in its guide to the instant loan cooling-off period.

If you borrow through apps to keep up with card dues or other EMIs, the combined cost can add up. One structured EMI may or may not cost less in total after fees. Check your options with BillCut.

What data can a loan app collect from your phone?

Data collection must be need-based and done with your prior, explicit consent. Apps should not access your file and media, contact list, call logs or telephony functions.

You can deny consent for specific data, revoke consent already given, and ask the lender or its service provider to delete or forget your data. The Directions also require data to be stored only on servers located in India. For more, see BillCut’s piece on data consent rules for borrowers.

What other protections do the 2025 rules give you?

Money goes straight to you. Disbursal must be to your bank account, and repayment to the lender’s account, not through a third party’s pool account.

Fair loan comparisons. When an app shows offers from several lenders, it must name each lender and show the amount, tenure, APR, monthly repayment and any penal charges, with a link to each KFS. The RBI’s press release on the Directions lists transparency in loan products from multiple lenders as a new area.

Notice of recovery agents. The lender must send you the recovery agent’s details by email or SMS before the agent contacts you. It works with lending partners to help eligible borrowers move high interest dues, such as credit card balances and personal loan EMIs, into one structured EMI. BillCut earns from helping borrowers refinance, so it has an interest in this option. Approval and terms depend on the partner lender and the total cost after fees.

Frequently asked questions

What rights do the RBI’s 2025 digital lending rules give borrowers?

The Reserve Bank of India (Digital Lending) Directions, 2025, issued on 8 May 2025, give you rights on the KFS, cooling-off exit, direct money flow, data use and grievances when you borrow from a regulated lender through an app.

What is the cooling-off period on a loan app?

It is a period, set by the lender’s board and at least one day long, in which you can exit a digital loan by paying the principal and proportionate APR without penalty.
