If you plan to sell house to repay home loan dues, the broad idea is simple. The sale money clears the loan, the lender closes the account, and your property papers come back to you. The details need care, because the loan is usually secured on the very property you are selling. This post explains the order of steps, the paperwork and the RBI rules that protect you. It does not cover tax, so speak to a tax professional about that.

Why does the lender matter when I sell a mortgaged house?

While the loan is open, the lender usually holds a claim on the property and often keeps the original papers. A buyer will want a clear title, so the loan normally has to be closed as part of the sale. Plan this with your lender, the buyer and a lawyer.

What are the steps?

  1. Read your loan agreement for foreclosure terms, notice periods and any charges.
  2. Ask the lender for a foreclosure statement, which shows the amount needed to close the loan on a given date.
  3. Agree the sale price and payment plan with the buyer. Many deals route part of the price straight to the lender. Put the plan in writing, with a lawyer.
  4. Pay the lender from the sale money and get written closure confirmation.
  5. Collect your original property documents.
  6. Check that the lender has updated your credit record.

Will I be charged for closing the loan early?

It depends on the loan. RBI’s pre-payment directions say that no pre-payment charges may be levied on floating rate loans for non-business purposes granted to individuals, whether the pre-payment is partial or full, and the Directions apply to loans sanctioned or renewed on or after 1 January 2026. For other loans, the same directions say charges follow the lender’s approved policy and must be disclosed in the sanction letter and agreement.

For retail loans sanctioned on or after 1 October 2024, RBI’s Key Facts Statement rules add that fees or charges not mentioned in the KFS cannot be charged by the lender at any stage during the term of the loan unless the borrower explicitly consents.

Item to check Where to look
Outstanding principal Foreclosure statement and loan statement
Interest up to the closure date Foreclosure statement
Pre-payment or foreclosure charge, if any Agreement, KFS, sanction letter
Validity date of the figure Foreclosure statement

How soon must I get my documents back?

RBI has set a clear timeline. Its circular says regulated entities must release original documents and remove registered charges within 30 days after full repayment or settlement of the loan account. If the delay is the lender’s fault, the circular says the lender must pay compensation of 5,000 rupees for each day of delay, and it must explain the reasons. The circular covers cases where release falls due on or after 1 December 2023.

It also says you may collect the documents from the branch where the loan account was serviced, or from another office of the lender that holds them. Keep the closure letter.

What should I check on my credit report afterwards?

Once the loan is closed, make sure your record shows it correctly. CIBIL’s FAQ says that if you receive a confirmation from the credit institution about submission of revised data, you can check the updated status through CIBIL. Ask the lender to send the revised data, keep that confirmation, and review your report after a reasonable time. If an old account still shows as open, raise it with the lender first.

What does an illustrative example look like?

This is an illustrative example with round numbers, not a BillCut offer. A house sells for 80 lakh rupees and the foreclosure statement shows 50 lakh rupees due on the closure date. Before sale costs and any tax, about 30 lakh rupees would remain. If the sale price were only 45 lakh rupees, a gap of 5 lakh rupees would remain on the loan. In that case, speak to the lender before agreeing to sell, since terms and outcomes depend on the lender and the facts.

What if the sale does not cover the loan?

A shortfall means you still owe the balance. Talk to the lender early about options, and ask a lawyer to review any settlement in writing. Do not ignore notices, as lawful dues remain payable. Our guides on avoiding foreclosure penalties, early prepayment pros and cons, home loan balance transfer benefits and property paper issues that delay loans may help.
