In the personal loan foreclosure vs part payment choice, foreclosure closes the whole loan at once, while part payment reduces the balance and keeps the loan running. Which one costs less depends on your loan agreement, your cash on hand and whether charges apply. Check the charges first, then compare.

What is the difference between foreclosure and part payment?

Point Foreclosure Part payment
What you pay The full outstanding amount plus any charges A chosen lump sum towards the principal
Loan status after Closed Still active
Future EMIs None Lower EMI or shorter tenure, as the lender allows
Cash needed High Flexible
Papers to collect Closure letter, no dues certificate Updated repayment schedule

What does RBI say about prepayment charges?

The RBI Pre-payment Charges on Loans Directions, 2025 were issued on 2 July 2025. They apply to loans and advances sanctioned or renewed on or after 1 January 2026. They cover commercial banks other than payments banks, co-operative banks, NBFCs and All India Financial Institutions.

  • For non-business loans to individuals on a floating rate, no pre-payment charges apply.
  • The no-charge rule holds for both part and full pre-payment, whatever the source of funds.
  • No minimum lock-in period applies to covered loans.
  • For fixed-rate loans, the lender’s approved policy decides. A term loan charge must be based on the amount prepaid.
  • Any charge must be disclosed in the sanction letter, loan agreement and Key Facts Statement where required. Undisclosed charges cannot be levied.
  • No charge applies when the lender itself starts the pre-payment.

The same rules are repeated for All India Financial Institutions in their responsible business conduct directions. So the first step is simple. Open your loan agreement and check whether your loan is floating or fixed, and when it was sanctioned.

How do the two options compare in an illustrative example?

The numbers below are illustrative only. They are not a BillCut offer and do not reflect any lender’s terms.

Item Foreclosure Part payment
Outstanding principal Rs 2,00,000 Rs 2,00,000
Amount you pay now Rs 2,00,000 plus any charge Rs 50,000
Balance left Nil Rs 1,50,000
Result No more interest Interest falls because the balance is lower

If a 4 percent charge applied to the prepaid amount, foreclosure would add Rs 8,000, and the part payment would add Rs 2,000. A charge like this is a possibility on fixed-rate loans under lender policy, not a rule. If your loan falls under the no-charge rule, both options cost nothing extra in fees.

When does foreclosure make more sense?

  • You have a large sum available and no better use for it.
  • You want to remove the EMI from your monthly budget.
  • The loan carries no prepayment charge, or the charge is small next to the interest you will save.

When does part payment make more sense?

  • You want to keep some cash for emergencies.
  • You can pay in several instalments over the year.
  • You want to bring down the interest burden without emptying savings.

Ask the lender whether a part payment reduces your EMI or your tenure. Both lower your total interest, but the monthly effect is different. Our guides on early loan prepayment pros, cons and charges and why banks charge early closure fees go deeper into this.

What should you do after foreclosing?

Ask for a closure letter and a no dues certificate. For secured loans, original documents must be released as per the RBI notification on release of property documents, which sets a 30 day limit from full repayment or settlement. CIBIL says on its FAQ page that lenders report data every 30 to 45 days, so check your credit report after that window. Our post on avoiding foreclosure penalties lists more steps.

Does the no-charge rule cover part payment too?

Yes. The RBI directions say the no-charge rules apply to both part and full pre-payment.

Can a lender force a lock-in period?

For loans covered by the no-charge rules, the directions say no minimum lock-in period applies.

How do I know if my loan is fixed or floating?

Check your sanction letter, loan agreement or Key Facts Statement. Ask the lender if it is unclear.

It may lower the EMI or shorten the tenure. This depends on how your lender applies it, so ask before you pay.

A closure letter, a no dues certificate and, for secured loans, your original documents.

When will my credit report show the closure?

CIBIL says lenders report every 30 to 45 days, so allow time and then check your report.
