If you are wondering about loan settlement fraud what to do next, act in the first few hours. Stop sending money, call your bank, call the national cyber crime helpline 1930, and file a complaint on the cyber crime portal. Then keep every message, receipt and number as proof. Speed matters because the faster a complaint is logged, the better the chance of stopping the money from moving on.
This guide is for borrowers who paid a stranger who promised to settle, reduce or close a loan, and then found the offer was fake.
How does a fake loan settlement offer work?
A caller or messenger claims to represent your bank or a recovery team. They say your loan can be closed for a small one time payment. They ask you to pay into a personal account or a payment link, and they push you to hurry. After you pay, the lender still shows dues, or the caller asks for more money.
Real settlements are agreed in writing with the lender itself. Our guide on fake loan settlement scams lists the warning signs in detail.
What should you do in the first hour?
- Stop paying. Do not send any “release fee”, “NOC fee” or “tax” even if the caller threatens legal action. The RBI has cautioned people against making remittances in response to such offers.
- Call your bank. Ask them to flag the transaction and the receiving account. Note the complaint number they give you.
- Call 1930. The Government of India says this toll-free helpline helps people lodge online cyber complaints.
- File online. The National Cyber Crime Reporting Portal at cybercrime.gov.in takes complaints on all types of cyber crime, and reports go to State or UT police.
- Save evidence. Do this before you block anyone.
Which details should you keep as evidence?
| Item | Why it helps |
|---|---|
| Transaction ID, date, time, amount | Lets the bank trace the payment |
| Receiver account, UPI ID or phone number | Identifies where the money went |
| Screenshots of chats, texts and payment pages | Shows what was promised |
| Call log with times | Links the caller to the payment |
| Your real loan statement | Shows what you actually owe |
Keep the complaint acknowledgement number from the portal and from the bank. You will need it if police or your bank follow up.
Will you get your money back?
No one can promise that. The RBI has stated that it does not take responsibility for recovering money sent in response to bogus offers. The Government has said the national fraud reporting system exists to stop fraudsters from siphoning off funds, which is why quick reporting is useful.
The RBI also has a circular on unauthorised electronic transactions. Under that circular, a customer should notify the bank as early as possible, and zero liability can apply in some cases if you report within three working days. The same circular says that where the customer shared credentials, the customer bears the loss until the report is made. Many settlement scams involve payments you made yourself, so the bank may treat them differently. Ask your bank in writing how it classifies your case.
What should you do about the real loan?
The fake settlement does not change what you owe. Contact your actual lender using the number on your loan statement or its official app, and ask for the current outstanding amount in writing. For digital loans, the RBI Digital Lending Directions say you can escalate a complaint to the RBI if the lender has not replied within 30 days. If the lender is open to a settlement, it will confirm terms in writing and take payment only into its own account.
Check your credit report for the account status as well. If you are being harassed by genuine recovery agents, see our guide on filing a complaint against loan harassment.
If the dues themselves are the problem, a structured option may help. Check your options with BillCut.
How can you spot the next scam attempt?
- Genuine lenders do not ask you to pay into a personal account.
- They do not ask for your OTP. Read about OTP scams.
- Scammers often know your loan details because data leaks. Knowing your name and amount is not proof of identity.
- Be careful of anyone claiming to be from a credit bureau. See the fake credit bureau call scam.
Illustrative example
This example is illustrative only and is not a BillCut offer. Asha owes Rs 80,000 on a personal loan. A caller offers to close it for Rs 25,000 paid to a mobile number. She pays, then is asked for Rs 10,000 more. She stops, calls her bank, calls 1930, files a portal complaint, and saves the chat. She then asks her real lender for a written outstanding statement. Her loan is still open, but she has lost no further money and has a paper trail.
