An income tax refund adjusted against outstanding demand means the tax department has set your refund against an amount it says you owe, instead of paying it to your bank account. This usually happens when a demand is pending against your PAN and you did not respond to it. This guide explains how to check the demand, how to respond and why a refund can seem delayed.

Why was my refund adjusted against a demand?

The Income Tax Department gives you a chance to confirm whether a stated demand is correct. If you do not respond, the e-Filing portal says the demand will be confirmed and adjusted against your refund, if any. If there is no refund due, the demand stays payable against your PAN.

So a refund that never arrives may not be a delay at all. It may have been set off against an older demand, in full or in part.

How do I check if I have an outstanding demand?

You can look for it yourself on the official portal. Do not rely on a link in a message or on a call from someone who says they can clear it.

  1. Log in to the e-Filing portal at incometax.gov.in.
  2. Go to Pending Actions and open Response to Outstanding Demand.
  3. Look for demands with the status Pending payment or Response.
  4. Click Pay Now or Submit Response against the demand you want to review.

The department also sends a message to your registered email and mobile number. The portal page for this service has download buttons for the latest section 245 notice and for notices issued earlier. Read these first, because they show the demand you are being asked to respond to.

You can read the steps on the department’s own page for responding to outstanding demand.

What are my options when I respond?

Your view of the demand What the portal lets you do
Demand is correct, not paid yet Select Demand is Correct, choose Not paid yet and use Pay Now
Demand is correct, already paid Select the already paid option, add the challan details and attach the challan PDF, up to 5 MB per attachment
You disagree in full or in part Choose Disagree, add one or more reasons with details, and pay the part you accept
Your reason is not listed Select Others, enter your reason and the amount you say is not payable

One warning from the portal matters. Once you submit a response as Demand is correct, you cannot disagree with that demand later. Check the figures before you submit. The department explains each path in its user manual for this service.

How do I see how much of my refund was adjusted?

Open the refund status for the assessment year. The portal lists four statuses: refund issued, refund partially adjusted, full refund adjusted and refund failed. To reach it, go to e-File, then Income Tax Returns, then View Filed Returns. Pick the assessment year and click View Details.

The department says refunds usually take 4 to 5 weeks after e-verification. A partial adjustment means some of the refund was set off and the rest may follow.

Is a failed refund the same as an adjusted refund?

No. A failed refund means the money could not be credited. The refund status page names these reasons:

  • PAN not linked with Aadhaar, which makes the PAN inoperative
  • Bank account not pre-validated
  • Name mismatch between the bank account and PAN details
  • Invalid IFSC code
  • Closed account listed in the return

Only a validated bank account can be nominated to receive a refund. The portal updates validation status within 10 to 12 working days, according to its bank account FAQ. If a refund fails, you can raise a refund reissue request from Services on your dashboard. You need a validated account and one verification method, such as an Aadhaar OTP, a DSC or an EVC. See the official refund reissue manual, and the refund status manual for how to read each status.

What if the adjustment leaves my budget short?

A refund that was meant for a bill or an EMI date can leave a gap when it is set off against a demand. Treat the refund as uncertain until it is credited. Plan the month on your income that is already in hand.

A short illustrative example

This example is illustrative and is not a BillCut offer. Say a refund of Rs 20,000 is due and an old demand of Rs 12,000 is pending. If the demand is confirmed and adjusted, the status could show a partial adjustment. The remaining Rs 8,000 would then follow the normal refund process. Your own case depends on the figures in your notice.

How BillCut can help

BillCut is a balance transfer and debt reduction platform. It works with lending partners to help eligible borrowers move high interest dues, such as credit card balances and personal loan EMIs, into one structured EMI. BillCut earns from helping borrowers refinance, so it has an interest in this option. Approval and terms depend on the partner lender. BillCut does not handle tax filings or tax demands.

Frequently asked questions

Can the department adjust my refund without telling me?

The portal says you are given an opportunity to respond to a demand. If you do not respond, the demand is confirmed and adjusted against your refund, if any. You also get a message on your registered email and mobile number.

Where do I see the outstanding demand?

Log in to the e-Filing portal, go to Pending Actions and open Response to Outstanding Demand. Demands needing action show the status Pending payment or Response.

Can I disagree with only part of a demand?

Yes. You can disagree in full or in part, select reasons and add details for each. If you disagree in part, you should pay the portion you accept.

What happens if I mark the demand as correct by mistake?

The portal warns that once you submit a response as Demand is correct, you cannot disagree with the demand later. Check the notice before you submit.

How long does a refund usually take?

The department says refunds usually take 4 to 5 weeks after e-verification. A refund that was adjusted against a demand will not be credited to your account.

Why would a refund fail instead?

The portal lists reasons such as PAN not linked with Aadhaar, a bank account that is not pre-validated, a name mismatch, an invalid IFSC code or a closed account.

Can I request a refund again after a failure?

Yes. Use Refund Reissue under Services on the e-Filing dashboard. You need a validated bank account and a verification method such as an Aadhaar OTP, DSC or EVC.
