A credit card Lok Adalat settlement is an agreement on overdue card dues reached through a Lok Adalat, a conciliation forum, instead of a long court case. If both you and the lender agree, the award is final and binding, and it cannot be appealed. This guide explains the process in general terms. It is not about any single card issuer.

What is a Lok Adalat?

A Lok Adalat is an alternative way to settle disputes. India’s Legal Services Authorities Act, 1987 is its legal base. Government material describes it as a co-operative, non-adversarial approach in which parties negotiate a solution they can both accept. The forum does not decide who is right. PIB explainer on Lok Adalats

Lok Adalats take up cases that are pending in court and also disputes at the pre-litigation stage, which means before a case is filed. National Lok Adalats are held on fixed dates across the country, and E-Lok Adalats allow people to join remotely.

Can credit card dues be settled there?

A report from the Ministry of Law and Justice on a National Lok Adalat for bank matters says that bank related disputes were taken up, including recovery suits and cheque dishonour cases, both pre-litigation and pending. PIB report on a Lok Adalat for bank matters Overdue card dues that a lender is chasing can fall in this kind of category. Whether your case is listed depends on the lender and the legal services authority, so do not assume it will be listed. Any listing is normally communicated through a notice.

How does the process usually run?

  1. You get a notice. It names the date, venue or link, and the lender’s claim.
  2. Check the claim. Compare the amount with your card statements and the card agreement.
  3. Prepare an offer. Decide what you can pay, and whether in one payment or by a set schedule.
  4. Attend the sitting. You and the lender’s representative talk with the conciliators.
  5. Record the settlement. If both sides agree, the terms are written as an award.
  6. Pay as recorded. Pay by traceable bank transfer and keep every receipt.
  7. Collect closure proof. Ask for a closure or no dues letter from the lender.

What should you carry?

The notice itself decides the final list, but these papers are usually useful.

  • The Lok Adalat or lender notice, in original and a copy
  • A photo ID and address proof
  • Your card statements and any repayment receipts
  • The card agreement or welcome kit, if you have it
  • Records of past messages or calls with the lender about the dues
  • Proof of the amount you plan to pay, such as a bank balance statement
  • A pen and a notebook to write down what is agreed

Our guide to how to negotiate with recovery teams has tips on talking about amounts.

Is it cheaper and safer than going to court?

Point What PIB material says
Cost No court fee is payable to file in a Lok Adalat, and fees already paid are refunded when the case settles
Outcome The award is deemed a civil court decree
Appeal No appeal lies against the award in any court
Both sides must agree It is conciliation, so no settlement happens without consent

The no appeal rule cuts both ways. Once you agree, you cannot reopen the deal, so read the terms before you sign. See also the PIB note on Lok Adalat awards.

What does it do to your CIBIL record?

If you pay less than the full dues, the card account is reported as settled, not closed. CIBIL says lenders view settled as risky. It also describes a case where the status moved to closed after the balance was paid, a no objection certificate was obtained, and a dispute was raised. What is an illustrative example?

This example is illustrative only and is not a BillCut offer. A borrower owes Rs 1,80,000 on a card after months of minimum payments. A notice arrives for a Lok Adalat sitting. The borrower brings statements and ID, agrees a lump sum with the lender, pays it by bank transfer, and asks for a closure letter. The account shows as settled. Real outcomes depend on the lender and the facts.

How BillCut can help

It works with lending partners to help eligible borrowers move high interest dues, such as credit card balances and personal loan EMIs, into one structured EMI. BillCut earns from helping borrowers refinance, so it has an interest in this option. Approval and terms depend on the partner lender. It is not a way to attend or arrange a Lok Adalat.
