Can Recovery Agents Visit My Office? Rules You Should Know

Can recovery agents visit my office? This is a common worry for borrowers with overdue EMIs. The short answer is that the RBI documents we reviewed do not say where an agent may or may not meet you. They do set clear limits on how any recovery must be done: no intimidation, no public humiliation and no intrusion on the privacy of the people around you. This guide sets out those limits and what you can do.

What do RBI rules say about the place of recovery?

RBI’s 2008 circular on recovery agents does not state where recovery may take place, and its 2022 circular does not mention workplaces either. We could not find any RBI line that allows or bans an office visit as such. So the useful question is how the visit is done. Whether a particular visit is lawful depends on the facts, so speak to a qualified lawyer if one has already happened.

What conduct is clearly not allowed?

RBI’s 2022 circular on regulated entities that use recovery agents says they must not use intimidation or harassment of any kind, verbal or physical. It also lists these points:

  • No humiliating a borrower in public.
  • No threatening or anonymous calls.
  • No misleading statements.
  • No calls before 8:00 a.m. or after 7:00 p.m.
  • No intruding on the privacy of family members, referees and friends.

The lender stays responsible for what its agents do. Colleagues and managers are not the borrower, so approaching them to discuss your dues may raise a privacy question. RBI’s fair practices guidelines also tell lenders to avoid undue harassment, bothering borrowers at odd hours and the use of muscle power in recovery.

How should a genuine agent identify themselves?

RBI’s 2008 circular says an agent should carry a copy of the notice and the authorisation letter from the bank along with an identity card. It also says banks should tell borrowers the recovery agency’s details and phone numbers when they pass on a case.

For digital loans, RBI’s 2025 directions say the borrower must get the agent’s details by email or SMS before the agent contacts them. If someone arrives with no papers and no prior notice from your lender, note that down.

Check What to look for
Name of lender Matches your loan papers
Authorisation letter Issued by the lender
Identity card Issued by lender or agency
Prior notice Agency details sent to you
Behaviour Calm, private, within hours

What should you do if an agent turns up at work?

  1. Stay calm and ask for the agent’s name, identity card and authorisation letter.
  2. Ask to speak privately, away from colleagues.
  3. Do not sign anything you have not read.
  4. Write down the date, time, name and what was said.
  5. Tell the lender in writing and keep a copy.

Illustrative example: an agent comes to an office at 11 a.m. and loudly names the borrower’s loan in front of the team. The borrower asks for papers, moves the talk to a quiet room and emails the lender that evening with a short account. That written record is what a complaint later needs. This is only an example.

For talking points, see our guide on your rights on recovery calls. A respectful conversation about a repayment plan usually serves you better than avoiding the lender. Read how to negotiate with recovery teams.

How do you complain about an agent?

First complain to the lender. RBI’s Integrated Ombudsman FAQ says you can approach the RBI Ombudsman if the lender does not reply in 30 days or you are not satisfied. Filing is free, online at cms.rbi.org.in. Our walkthrough on filing a complaint against loan harassment explains the steps. If you feel physically threatened, contact the police. Our note on digital collection rules adds more.

Frequently asked questions

Can a recovery agent come to my workplace?

The RBI documents we reviewed do not address workplace visits. They do bar harassment, public humiliation and intruding on the privacy of others.

Can an agent tell my colleagues about my loan?

RBI bars humiliating borrowers in public and intruding on the privacy of family, referees and friends. Disclosure at work can raise a privacy concern.

What time can agents call?

RBI says not before 8:00 a.m. and not after 7:00 p.m.

What papers should an agent carry?

RBI says a copy of the notice, the lender authorisation letter and an identity card.

Is the lender responsible for its agents?

Yes. RBI says regulated entities remain responsible for the recovery work they outsource.

Where can I complain?

Complain to the lender first. After 30 days without a reply, or if unhappy, file free with the RBI Ombudsman at cms.rbi.org.in.

Does this mean I can ignore my dues?

No. Dues remain payable. These rules cover how recovery is done, not whether you owe the money.
