Can bank call relatives for loan recovery? In general, no. RBI directions bar lenders and their agents from intruding on the privacy of a borrower’s family members, referees and friends. A lender may contact you about a due. It may not harass you or the people around you. This guide explains what the rules say, where they stop, and what you can do. It is general information, not legal advice.
What do the RBI rules say about contacting family?
RBI’s directions for NBFCs list acts a lender or its agents must not carry out. Under the NBFC Responsible Business Conduct Directions, 2025, para 100 bars intruding on the privacy of the debtor’s family, referees and friends. The same list covers public humiliation, threatening or anonymous calls, inappropriate messages including on social media, and false or misleading statements about the debt.
Credit card rules are similar. The Credit Card and Debit Card Directions, 2022, para 13(c) bars intimidation and intrusion on the privacy of cardholders’ family members, referees and friends. Para 13(e) says only the customer information an agent needs for recovery may be shared with the agent.
What other limits apply to recovery calls?
Beyond family privacy, the rules set conduct limits. This table summarises what the directions above say.
| Topic | What the rules say |
|---|---|
| Calling hours | NBFC directions restrict calls before 8 a.m. and after 7 p.m. and bar persistent calling |
| Force or threats | RBI’s Fair Practices Code guidelines bar undue harassment and the use of muscle power |
| Agent accountability | Lenders must train agents and are responsible for what their agents do |
| Agent details | Credit card directions require agent details to be shared with the cardholder |
RBI’s Fair Practices Code guidelines for lenders say lenders should not resort to undue harassment, such as bothering borrowers at odd hours or using muscle power. Note that the exact calling window can differ by lender type and loan type, so check the rules that apply to your loan.
Does a relative who signed the loan count differently?
Yes, it can. A relative who signed as a co-applicant or guarantor is a party to the loan documents. A relative who signed nothing is a third party. The directions I reviewed do not set out a separate rule on contacting guarantors, so what a lender may do there depends on the loan agreement and the facts. A qualified lawyer can read your documents and advise. For background, see this guide on co-applicant responsibility when a loan goes into default.
What should I do if a lender or agent calls my family?
- Stay calm and keep a record. Note the date, time, number and what was said. Save screenshots of messages.
- Ask the caller for their name, the lender they represent and a contact for a senior officer.
- Write to the lender’s grievance contact and describe what happened. Attach your notes.
- If the lender does not reply, or you are not happy with the reply, escalate to RBI. The Integrated Ombudsman Scheme FAQ says you must first approach the lender, and can go to the Ombudsman after 30 days with no reply or if you are dissatisfied with the reply. Complaints can be filed online on the RBI CMS portal.
More practical steps are in our guides on how to file a complaint against loan harassment and your rights during recovery calls.
Does this mean I can ignore the dues?
No. These rules protect your dignity and privacy. They do not cancel the loan. Unpaid dues can still hurt your credit record and the lender can pursue lawful steps. A calm, early conversation with the lender about a revised plan is usually more useful than silence. Our guide on how to negotiate with recovery teams covers how to prepare.
Illustrative example
This is an illustrative example with made-up details. Asha misses two EMIs on a personal loan after a medical bill. An agent starts calling her sister at 9 p.m. and says Asha is a defaulter. Asha notes the dates and times, writes to the lender’s grievance contact, and asks that her family not be contacted. If the lender does not respond within 30 days, she can take the matter to the RBI Ombudsman. Outcomes depend on the facts and the lender.

Frequently asked questions
Can a bank call my relatives about my loan?
RBI directions bar lenders and their agents from intruding on the privacy of a borrower’s family, referees and friends. Persistent or abusive calls to relatives can be a ground for a complaint.
Can a recovery agent call me at night?
NBFC directions restrict calls before 8 a.m. and after 7 p.m. and bar persistent calling. Rules can differ by lender type, so check the ones that apply to your loan.
Can the lender tell my relatives that I am a defaulter?
Public humiliation and false or misleading statements about a debt are listed as prohibited in the RBI directions I reviewed.
What if my relative was my guarantor?
A guarantor is a party to the loan documents. The directions reviewed do not set a separate rule on this, so ask a qualified lawyer to read your agreement.
Where do I complain about recovery harassment?
First write to the lender. If there is no reply in 30 days, or you are unhappy with it, you can file on the RBI CMS portal under the Integrated Ombudsman Scheme.
Do these rules cancel my dues?
No. They govern how a lender may behave. The loan stays payable, and you remain free to discuss a revised plan with the lender.
Should I get legal help?
If you face threats, repeated harassment or a legal notice, speak to a qualified lawyer. Outcomes depend on the facts and the lender.
